Spence Chevrolet has received a number of questions regarding changes to application of Georgia TAVT to leased vehicles. As background, House Bill 340 was passed by the General Assembly in 2017 and was signed into law by Governor Deal. Under the new law, leased vehicles no longer will be taxed on the full value of the vehicle. Instead, TAVT will be calculated by multiplying the tax rate by “the total of base payments pursuant to the lease agreement.” These changes are effective January 1, 2018.

The new regulations proposed by Georgia Department of Revenue state that, for the new vehicles that are leased, TAVT will be calculated by multiplying the tax rate by “the total number of base payments, including down payments, pursuant to the lease agreement.”
